Findings of the Con3Post project
The findings of the Con3Post project investigating mobility and posting flows between third countries, EU-sending and EU-receiving countries indicated that immigration of third country national (TCN) workers is driven largely by economic discrepancies and wage disparities between the third countries and EU countries, as well as political and economic instabilities in the third countries. We found that
- some companies have become quite active in the wider European markets providing services through posting of TCNs, which has in many cases become a business model for profit maximisation;
- the intersection of the migration and employment regimes may enhance the vulnerabilities of posted TCN workers, who tend not to defy or report their employers, on whom they depend not only for employment but also for the renewal of their work and residence permits in the sending country;
- despite the mechanisms for control and enforcement of national/EU standards, the vulnerability of TCN posted workers persists due to the cloaking effect of the posting employment characterised by subcontracting, cross-border mobility and temporary service provision.

The final conference of the Con3Post project took place via Zoom on 10 December 2020. The Con3Post Conference brings together researchers from five European countries (Slovenia, Austria, Italy, Finland and Poland) to present and discuss the findings of the empirical research on posting of third country nationals in the EU construction sector. The European Centre started the new POW-Bridge project on the gap between procedures and practices in posting of workers company regulation covering Austria, Slovenia, Italy, Slovakia, Hungary, Poland, Serbia, and North Macedonia.
The new two-year project studies the gap between procedures (legal basis) and practices (experiences) in posting rule enactment, identifies challenges and develops and shares effective ways of addressing these challenges for posting companies and implementation agencies. The strategic objectives include: to promote and enhance effective and transparent application of EU rules on posting; to promote a more active participation of employers in the process of evidence-based policy-making; and to establish, consolidate and expand multi-stakeholder cross-border collaboration among EU Member States and candidate countries. The project funded by the EaSI Progress programme is going to develop research, cooperation and dissemination activities in eight countries: six EU Member States and two candidate countries.The European Centre iss Lead Partner and collaborating with six international partners for the implementation of this project. The peer review focused on occupational safety and health of posted workers (OSH) in the European Union (EU). The presentations and discussions during the peer review focused on the legal framework at both the EU level and the national levels.
The peer review focused on occupational safety and health of posted workers (OSH) in the European Union (EU), an issue that only recently has received some attention. The presentations and discussions during the peer review focused on the legal framework at both the EU level and the national levels. OSH related vulnerabilities of posted workers were systematically analysed and explained, and employer’s role and responsibilities in relation to the OSH of posted workers discussed. As an illustrative example, a case of a work accident of a posted worker from Slovenia was presented. After the Slovenian case, the Italian and German cases were introduced. Discussions during the working groups additionally addressed legal and health care mechanism and practices in case of work-related accidents. Furthermore, ideas and suggestions on measures to prevent or reduce OSH-related vulnerabilities were exchanged. Read more about the project here.

In this new Policy brief, the authors present language barriers faced by posted workers in nine European Union countries (Austria, Belgium, Croatia, Germany, Italy, Romania, Slovakia, Slovenia and Spain) and discuss the implications these may have for their occupational safety and health (OSH). As the fastest-growing form of temporary cross-border labour mobility in the EU, posted workers are faced with language barriers which significantly limit the capacity of posted workers to realise and exercise their employment rights, including health and safety rights. The Brief offers recommendations for policy that could help reduce OSH risks many posted workers are exposed to due to language barriers.

The focus of the peer review was on the bilateral and multi-lateral cross-border mechanisms and tools employed by Member States in order to better implement the Directive 96/71/EC. The event was greeted by Alessia Rosolen, Assessor for Employment, Training, Education, Research, University and Family (Friuli-Venezia Giulia Autonomous Region), Maurizio Romano, Representative for labour policies (Friuli-Venezia Giulia Autonomous Region, Directorate on Labour, Training, Education and Family), and Federico Pancaldi, European Commission, DG Employment (web conference). Sonila Danaj, EEPOW Coordinator, introduced the project. Luigi Gennari (Labour Inspectorate Trieste and Gorizia), Mercedes Landolfi (National reponsible FILLEA-CGIL on immigration policies and coordination of foreign workers), Feliciano Iudicone (Fondazione Giacomo Brodolini) and Giacomo Virgilio (Joint National Committee for Construction Workers’ Welfare Funds – CNCE) presented the Italian experience. Whereas Sanja Cukut Krilić (ZRC SAZU, Slovenia) and Margarita Glaser (The Construction Workers’ Annual Leave and Severance Pay Fund/Bauarbeiter-Urlaubs- und Abfertigungskasse) presented the experience of the peer countries Slovenia and Austria, respectively.
The fourth country workshop happened in Skopje, Former Yugoslav Republic of Macedonia on November 6, 2018. The workshop organized by the local partner, the organization PUBLIC with the support of the European Centre, brought together representatives from the Macedonian Ministry of Labour and Social Policy, the various ministerial directorates, the Labour Inspectorate, the social partners, employment agencies and researchers to discuss the transposition of the Posting of Workers Directive in FYROM and the institutional capacities for implementing the Directive once the country becomes a member state.
